Do you need a license to make a MTG kind of game?

Iam thinking of starting to make a java game with MTG as inspiration, but ofc with my own names etc. But is this elligle? I don't want to break any laws doing this and therefore it would be private if I made anything, but just wonder what the rules about creating these kinda games is, because you see alot of them (E.G. Pokemon has something similar)

Well the thing I am in doubt about is if I am allowed to make cards with the same layout without using copyrighted pictures and names :S Just if the layout is patented, and its really confusing as not all counts when your not living in USA (I am from Denmark)

I don't think the layout is patented, but everything else including the tap symbol is. I sure you're safe.
